Wilmington Planning Board
Regular Meeting – 7 p.m.
March 2, 2009

Present: Bruce Huntington, Bert Yost, Marilyn Moncsko Glenn Gebel, Jack, Bridget and Noreen Levitt, Gilbert & Linda Joss-Dyke, Cindy Garso, Peter Vander Heide, Bob Guynup, Randy Preston, Peter Coffrin, Darrell Austen and Shirley Lawrence.

CALL TO ORDER
Bert Yost, Acting Chairman called the meeting to order at 7:03 p.m.

APPROVAL OF MINUTES:
Motion to approve February 2, 2009 minutes presented by Marilyn Moncsko, seconded by Glenn Gebel;
Carried unanimously.

OLD BUSINESS: Whiteface Outlook-North Sky Development-Jack Levitt
*The issues between Cindy Garso and Jack’s engineers have all been addressed.
*Would like to move forward with conditional approval.
*Bert Yost presented the conditions that were being considered:
APA approval of the road in the R-3 district
NYS Dept. of Health approval of the water distribution system.
Completion of a feasibility study to investigate the possibility of looping the water distribution system with the existing town water system on Quaker Mountain. It is assumed that Jack will pursue the looping solution if a reasonable agreement can be reached with all parties involved.
*Jack had no objections to these conditions.
*Bruce Huntington questioned if the looping would help solve the water pressure problems.
*Jack plans to have Kevin Hastings go over the data to determine if there is a problem.
*Cindy Garso stated that if there is a problem it can easily resolved by extending the line.
*Jack stated that the looping would need to be feasible and reasonable. Jack was concerned over creating more water problems for Tony Pascarelli if he had to put a water line close to his house.
*There was discussion on covenants to address the run off of water from the property.
*Bridgette stated that the purchaser of property is made aware of everything through a property disclosure statement that the purchaser has his attorney review and he signs.
*Motion presented by Glenn Gebel for approval based on the following conditions:
**APA approval of the road in the R-3 district.
**NYS Dept. of Health approval of the water distribution system.
**Completion of a feasibility study to investigate the possibility of looping the water
distribution system with the existing town water system on Quaker Mountain with the
assumption that the looping solution will be pursued if a reasonable agreement can be
reached with all parties concerned;
Motion seconded by Marilyn Moncsko; carried with yes votes from Glenn, Marilyn and Bert; Bruce Huntington voted no. Bruce feels there is a downstream liability.

Whiteface Overlook-Alan Oppenheim-cancelled.

WFEVentures-Peter Coffrin 8 lot subdivision
*Peter presented a new map.
*He has APA NJ letter.
*He had to re-map the project to isolate and protect the wetlands.
*All lots are 3+ acres.
*Peter has made application to DEC and DOH.
*There is a temporary permit to cross the new bridge brook to do soil investigation.
*Perk tests have been done on every site.
*Lots 1 and 2 need a rear setback variance to locate the houses out of the scenic corridor. Peter will
present his application to the ZBA on March 11th.
*Peter presented a sample of the covenants to the board for review.
*There will be a Homeowners Association and the road will be privately owned.
*All the engineering will be completed within two weeks.
*Bruce Huntington felt the roads and bridges should meet town specifications.
*Peter stated that nothing will be dedicated to the town and that the roads will be wide enough for emergency vehicles.
*Bruce questioned what guarantee the town would have that the bridges meet specs. Peter will submit a stamped engineering plan.
*Glenn Gebel feels the town engineer should review the bridge and possibly the SWMP.
*Peter will be on the agenda for the next meeting.

CORRESPONDENCE: Adirondack Park Local Government Conference- March 24 & 25th
*Bert Yost plans on attending the conference. There is to be a discussion on signs. The board will discuss signs at the next meeting.
