RESOLUTION 62-09 TOWN BOARD APPROVED MINUTES FOR 9/8/09 & 9/30/09.

Water Meter update- there are approximately 150 water meters to be updated.
Town received one bid for the installation of mosaic Automated Fixed Network Water Meter Reading System

RESOLUTION 64-09 TOWN BOARD WILL APPLY FOR $201,160.00 FROM ENVIRONMENTAL
PROTECTION FUND.

RESOLVED:
That Randy S. Preston, as Supervisor of the Town of Wilmington, is hereby authorized and directed to file an
application for funds from the New York State Environmental Protection Fund, Local Waterfront Revitalization
Program, in an amount not to exceed $201,160.00 and upon approval of said request to enter into and execute a
project agreement with the State for such financial assistance to the Town of Wilmington to implement various
Improvements to the Lake Everest Beach complex, including new restroom facilities and a sewage treatment
system, a new pavilion, repaving of the parking lot and new lighting, a handicapped-accessible fishing pier, boat
docks, and 10' wide, 700' long, multi-use recreational path. If appropriate, a conservation easement/preservation
covenant to the deed of the assisted property will also be executed.

Wesley and Nancy Gonyea gave the Town two easements to put a pump house on Quaker Mt. Rd near their residence May 15, 1978. That pump house has been removed after becoming obsolete after building the new
pump house on Manning Road. The Town will convey both easements back to them.







RESOLUTION 65-09 THE TOWN BOARD AUTHORIZES THE TOWN SUPERVISOR TO SIGN A QUIT
CLAIM DEED ON BEHALF OF THE TOWN RELINQUISHING THE TWO (2) EASEMENTS THAT
THE TOWN RECEIVED FROM WESLEY & NANCY GONYEA. PARCEL BEING THE SAME PREMISES CONVEYED BY WESLEY GONYEA & NANCY GONYEA TO THE TOWN OF WILMINGTON BY DEED AND RECORDED IN THE ESSEX COUNTY CLERKS OFFICE IN BOOK 666 OF DEEDS AT PAGE 78. THIS DEED IS MEANT TO TERMINATE THE EASEMENT PRESENTLY GRANTED TO THE TOWN OF WILMINGTON BY SAID DEED.








PARCEL I

ALL the right, privilege and easement for constructing, erecting, excavating for maintaining and repairing a pressure holding tank with necessary pipes and other accessories and equipment including piping to provide access thereto to be utilized in connection with the operation of said facilities over, under, on and across premises owned by the parties of the first part herein as conveyed to them by deed from Wilmington Development Company, Inc. which deed was dated June 20, 1977 and thereafter recorded in the Essex County Clerk’s Office in Book 638 of Deeds at Page 218; said premises being subject to this easement being bounded and described as follows:

BEGINNING at a point in the assumed easterly bounds of Fairview Terrace, so-called, which said point lies 20 feet, more or les from the northwest corner of lands owned by Wesley W. Gonyea and Nancy Gonyea as described in a deed recorded in the Essex County Clerk’s Office in Book 638 of Deeds at Page 218 which said point is also the southwest corner of an easement previously granted to the Town of Wilmington by the said Wesley W. Gonyea and Nancy M. Gonyea by deed recorded in the Essex County Clerk’s Office in Book 666 of Deeds at Page 78.

RUNNING THENCE southerly and along the easterly bounds of Fairview Terrace fifteen (15) feet, more or less, to a point;

THENCE easterly at 90° to the assumed easterly bounds of Fairview Terrace ten (10) feet, more or less, to a point;

THENCE northerly, parallel to the assumed easterly bounds of Fairview Terrace, fifteen (15) feet, more or less, to the southeast corner of the aforesaid easement previously granted to the Town of Wilmington;

THENCE westerly along the southerly bounds of said previously granted easement ten (10) feet, more or less, to the point or place of beginning;



It is intended herein to convey an easement running fifteen (15) feet north and south and ten (10) feet east and west immediately southerly to and adjacent to an easement previously granted to the Town of Wilmington by said deed recorded in the Essex County Clerk’s Office in Book 666 of Deeds at Page 78.

BEING the same premises conveyed by Wesley W. Gonyea and Nancy M. Gonyea to the Town of Wilmington by deed dated November 14, 1979 and recorded in the Essex County Clerk’s Office on November 19, 1979 in Book 697 of Deeds at Page 135. This deed is meant to terminate the easement presently granted to the Town of Wilmington by said deed.

PARCEL II
ALL the right, privilege and easement of constructing, in perpetuity of erecting, excavating for, constructing, maintaining, repairing and replacing a water pumping station with pump housing, pipes, water line and other accessories and equipment, over, under , on and across premises owned by the parties of the first part herein and. being a portion of premises described in a Deed from Wilmington Development Company, Inc., which deed was dated June 20, 1977 and thereafter recorded in the Essex County Clerk’s Office in Book 638 of Deeds at Page 218, said portion being the subject of this easement being bounded and described as follows:

BEGINNING at a point in the general easterly bounds of Fairview, Terrace, so-called, which said point lies 5 feet southerly, more or less, from the northwest corner of said premises conveyed to the parties of the first part in and by said deed above mentioned.

Running thence, southerly and along the assumed easterly bounds of said Fairview Terrace 15 feet, more or less to a stake;

Thence easterly at right angles to the assumed easterly bounds of Fairview Terrace 10 feet, more or less, to a stake;

Thence northerly and parallel to the assumed easterly bounds of Fairview Terrace 15 feet, more or less, to a stake;

Thence turning at an angle 90°, more or less, and running 10 feet more or less to the point or place of beginning.

BEING the same premises conveyed by Wesley W. Gonyea and Nancy M. Gonyea to the Town of Wilmington by deed dated May 15, 1978 and recorded in the Essex County Clerk’s Office on August 21, 1978 in Book 666 of Deeds at Page 78. This deed is meant to terminate the easement presently granted to the Town of Wilmington by said deed.

It is the intention of the Town of Wilmington by this deed to relinquish all right, title and interest given by the Grantee’s herein in the aforementioned Deeds.

Together with the appurtenances and all the estate and rights of the party of the first part in and to said premises,

To have and to hold the premises herein granted unto the parties of the second part, their heirs and assigns forever.
