Annual Organizational Meeting – January 5, 2010

RESOLVED that the following salaries be paid to employees on a bi-weekly basis in 26 payrolls:

Supervisor-Randy Preston; Annual - $20,473

Town Justices-Tim Kertz– Annual @ $7,174;

RESOLVED, that the Town of Wilmington accept for payment duly itemized vouchers that are certified and/or verified for payment. Vouchers must be received by the last day of the month for consideration at the next monthly meeting.

RESOLVED, that the regular monthly meeting of the Town Board of the Town of Wilmington be held in the Community Center on the second Tuesday of each month, to begin at 7 p.m. In the event that said is a legal holiday, the regular monthly meeting shall be held on Wednesday; and FURTHER RESOLVED, that special meetings shall be called as necessary to conduct the town’s business, such meetings to be held in the Community Center, on such dates as specified and to begin at such times as specified to conform with Town Law and New York State Open Meetings Law; meetings to be posted at stores and post office.

RESOLVED that the Press Republican and Lake Placid News be designated the official newspapers for the Town of Wilmington.

RESOLVED, that the following appointments be made for respective positions designated, to be paid in the manner described:

1) Town Engineer, as needed, to be paid on itemized vouchers for services rendered;

2) Registrar of Vital Statistics, Gerald Bruce to be paid according to the fees set by the State of New York.

3) Deputy Registrar of Vital Statistics, Shirley Lawrence to be paid according to the fees
set by the State of New York.

4) Town Health Officer, Dr. Harry Davis at no salary.

5) Town Historian, Merri Peck at no salary.

6) Dog Control Officer, Shirley Lawrence - Annual salary-$2,945;

7) Zoning & Code Enforcement Officer, Robert Guynup- $17,565.60 annual in 26 payrolls.

8) Budget Officer, Shirley Lawrence - Annual $924, paid first payroll in November.

RESOLVED, that James Martineau be engaged as Town Attorney, to be paid by voucher.

RESOLVED that during the year temporary and seasonal employees be employed by the Town of Wilmington to adequately carry out the business of the town and the rate of remuneration be affixed by the Town Board for each separate employee at the time the person is employed.

RESOLVED that a petty cash fund for the Town Clerk be established not to exceed $25; and
FURTHER RESOLVED that a petty cash fund for the Tax Collector be established not to exceed $50.

RESOLVED that the Superintendent of Highways be authorized to purchase necessary tools and implements during the year without prior approval of the Town Board in the amount not to exceed $1,000 (Highway Law Section 142, Paragraph 1A)

RESOLVED that the Board of Assessment & Review be paid $125 each member, to be paid by voucher following Grievance Day.

RESOLVED that any officer or town employee be reimbursed for the use of his/her car in the performance of official business for the Town of Wilmington at the rate of 50 cents per mile for actual miles traveled.

RESOLVED that the existing Employee Regulations, regarding benefits eligibility, leaves of absence, sick leaves, holidays, overtime, vacation, hospitalization and personal leave be continued.

RESOLVED that existing Procurement Guideline Policy, Affirmative Action Policy, Sexual Harassment Policy and Drug Free Workplace Policy as adopted by the Town Board be continued.

RESOLVED that NBT Bank of Lake Placid, New York be designated as a depository of the Town of Wilmington and that any of the officers, employees or agents of the Town of Wilmington be and each of them hereby is authorized from time to time to deposit any of the funds of the customer in said bank, either at its principal office or at any of its branches; and to endorse in the name of the Town of Wilmington all checks, orders or instruments so deposited by rubber stamp, facsimile, mechanical, manual or other signatures, and to waive presentment, demand, protest and/or notice of dishonor or protest with respect to any such check, order or instrument and that any checks, orders or instruments so deposited shall be deemed to have been unqualifiedly endorsed by the Town of Wilmington whether or not so endorsed. FURTHER RESOLVED that MBIA Class Accounts be used as interest bearing accounts for monies that are not immediately needed for operating expenses.

FURTHER RESOLVED, that both Supervisor Randy S. Preston and Deputy Supervisor, Stephen J. Corvelli be authorized to be the signers of the town’s official checks.

RESOLVED that the board authorizes the designation of unexpended funds in the 2009 town budget for expenditure in 2010, and establishing reserves in 2009 unappropriated fund balance therefore.

FURTHER RESOLVED that the Supervisor be authorized to make inter-departmental budget transfers in the 2010 town budget.

Town Board and Dave Baker discussed the Visitors Bureau’s 2010 marketing plan. Sue Hockert and
Visitors Bureau Board will meet with the Town Board the middle of January to discuss their future
Marketing Plan.

RESOLUTION 77-09 THE ORIGINAL WILMINGTON WATER DISTRICT WILL BE
–WATER DISTRICT #1- FOR THE PURPOSE OF CLARIFICATION
NOW THAT WILMINGTON HAS WATER DISTRICT #2

Town Board discussed lighting at the Beach and Bowman Lane. Compared steel lamps (could rust in 5-6-years)
to brass lamps, which are a little more expensive @ $261.00 each, but won’t rust.

RESOLUTION 73-09 THE TOWN BOARD APPROVED THE EXTENSION OF WATER DISTRICT #1

In the Matter Of the Establishment of the Town of Wilmington Extension #1 of Water District #1, in the Town of Wilmington, County of Essex, New York, Pursuant to Article 12 of the Town Law.

WHEREAS, the Town Board of the Town of Wilmington (the "Town Board" and the "Town", respectively), in the County of Essex, New York, had received a Petition dated November 17, 2009, pursuant to §191 of the Town Law for the establishment of an Extension of Water District #1 (the "District"), which Petition is signed by the owners of taxable real property situated in the proposed District, owning in the aggregate all of the assessed valuation of all of the taxable real property of the proposed District, as shown upon the latest completed assessment roll of said Town, and further that there are no resident owners of taxable real property in the proposed District owned by resident owners according to the latest completed assessment;

WHEREAS, said Petition purported to described the boundaries of the proposed District in a manner sufficient to identify the lands included therein as in a deed of conveyance and was signed by the petitioners and duly acknowledged or proved in the same manner as a deed to
be recorded; and

WHEREAS, the proposed District is bounded and described as follows:

ALL THOSE CERTAIN LOTS, PIECES OR PARCELS OF LAND lying and being in the Town of Wilmington, County of Essex, State of New York, and more particularly shown as Tax Map Parcel ID #26.3-1-25.090 and #26.3-1-80.000 as depicted and shown upon the 2009 Town of Wilmington Tax Maps. The parcels are located along the New York State Route 86 in the Town of Wilmington, County of Essex, State of New York.
WHEREAS, the Town Board has received a map, plan and report duly prepared by Robert M. Sutherland, P.C., competent engineers duly licensed by the State of New York for the proposed establishment of said District, which map, plan and report sufficiently describes the construction of the water system therein, consisting of a pressure station, including such pumps and pump systems and original equipment, machinery, furnishings, fittings, connections, fills, services, appurtenances and related water improvements, and said map, plan and report is on file in the office of the Town Clerk; and
WHEREAS, the Town Board has given due consideration to the impact that such construction may have on the environment; and
WHEREAS, the maximum amount proposed to be expended for the construction of the improvements in the Extension District is estimated to be $ 1.00 or less, and the plan of financing does not include the issuance of any serial bonds of the Town to finance said costs, and does not involve the assessment levy or collection of special assessments upon the two parcels of land located within the District, which the Town Board shall determine and specify to be especially benefited thereby, and
WHEREAS, the estimated cost to the typical property, as defined in the Town Law, based on current water rates charged within the Town, will be less than $624.00 annually; therefore the cost is not above the average estimated cost of the typical properties for the establishment of similar types of districts as computed by the State Comptroller, and
WHEREAS, the Town Board held a Public Hearing on December 8, 2009 at 7 p.m. to consider the establishment of the proposed District herein referred to and to hear all persons interested in the subject thereof concerning same it is hereby
ORDERED that the proposed extension of Water District #1 being same is hereby approved by the following vote:
